Estate settlement Page 1   2  Notice in the estate settlement (transcribed below) are Benjamin F. Devol (husband of Nancy Ann Turnham), Henry Spalding (husband of Lucy Ann Turnham) and Gideon Devol (husband of Francis Devol).  Gideon was first cousin of Benjamin: Gideon was son of Jonathan and Benjamin was son of Gilbert Devol Jr., Jonathan's brother.

Transcription of George Turnham's probate records:

 

In the name of God Amen.  I George Turnhma of Spencer County and State of Kentucky being weak in body but sound in mind and judgment, and considering the uncertainty of life, do make this my Last Will and Testament in manner and form following to wit

 

Item. I want all my just debts to be paid the first thing.

Item. I give and bequeath to my beloved wife, Nancy Turnham so long as she shall remain my widow, all my estate both personal and real, that shall remain after paying my just debts, leaving it with her and under her Control to manage as she may think proper except a piece or parcel of land containing about thirty acres, be the same more or less, lying by the side of the piece or parcel of land that Gideon Devol now lives upon, and between said Devol and Francis Jackson, containing the same course that the end lines of G. Devol’s present piece of land now does unite they intersect said Francis Jackson’s line, and including all the land that lies between these lines.  Now the above mentioned piece or parcel of land is hereby granted to G. Devol, or he is to have the privilege of having said piece of land, if he shall be able to purchase the same, and _________ to buy it; Nevertheless if the G. Devol does not purchase the above mentioned piece or parcel of land that he is to have the liberty of purchasing, then and in that case it is to be in the possession of my wife as the rest of my land to be under her control and management.

Item. My will and desire is that my wife Nancy shall give to each of my children that are now with her, namely, Thomas, George, Nancy and Sally, as they shall arrive to lawful age, a proportion of my estate to make them equal in property to those of my children that have married and are now living to themselves.

Item. My will and desire further is that the residue of my estate (if any) after making my younger children equal in property to the older ones, shall be equally divided amongst all my children after the death of my wife.

I hereby ordain constitute and appoint my beloved wife Nancy Turnham my Executrix with full power and authority to act and transact all my unsettled business of every kind whatever, to receive all and every debt due me either by note or otherwise as well as to pay all debts that I owe.

Item. My will and desire further is that as it respects my older children that have married, namely Frances Elizabeth and Lucy, I want them to have three hundred dollars each and if either one of them upon a settlement with the estate has not received as much as three hundred dollars, I want my Executrix to pay them the balance as soon as it is convenient for her to do it.

            In testimony whereof I have hereunto set my hand and seal this 30th day of June in the year of our Lord 1829.

At a County Court begun and held for Spencer County at the Court house in Taylorsville on Monday the 14th day of September 1829 this writing purporting to be the Last Will and Testament of George Turnham dec. was this day ordered and proved in open Court by Edmond Slone and John Overstreet the subscribing witnesses thereto and ordered to be recorded.

 

And on the motion of Nancy Turnham the Executrix named in the said will who made oath and executed and acknowledged Bond in the penalty of $4000. with Gideon Duvall, William Jewel, John W. Womack and Elisha Brooks her securities, conditioned according to Law.  Certificate is granted the same Nancy Turnham for obtaining a probate of said will in due form of Law.

In obedience to an order of the Spencer County Court in the State of Kentucky made at their February County Court 1834 appointing the undersigned Commissioners to make division of the personal estate of George Turnham deceased among his legal heirs and representatives do report that we met on the first day of March 1834 and all the heirs of George Turnham decd being present, to wit Gideon Duval, John S Gray Henry P Spalding Thomas Turnham Benjamin F Devol by James Beckham his in fact, George Turnham by Alexander W Thomas his guardian and Sally Turnham by Gideon Duval her guardian we first proceeded to make an estimate of said Estate as follows.

There is in the hands of Edmund Slone Administrator of George Turnham Deceased as per settlement, and subject to division the sum of $462:12½

Several of the above named persons and children and heirs of George Turnham Decd having received from the said George Turnham in his lifetime real & personal estate, by way of advancement and choosing to come into the distribution of said estate with the other persons entitled thereto we have brought their advancements into _____________ with the distributable surplus as follows to wit:

John S Gray has received one negro boy Ephraim at $150, 1 mare saddle bridle at $75 bed bedstead furniture at $30 bureau & table $26 Cow &calf $8 1 spinning wheel $2.50 Four sheep $4 and cupboard furniture $6      $301:50

Gideon Duval has received 10¼ acres of land at $100 horse saddle & bridle at $75 bed bedsted and furniture at $20 Bureau & table at $15 one bow at $8 cupboard furniture at $3 on littlewheel at $2.5     $223.50.

Henry P Spalding has received one horse saddle & bridle $75 one bed bedstead & furniture $40 one bureau $10 one cow & calf $8 cupboard furniture $10.87½      $143:87½ .

Thomas Turnham has received one horse at $40              40.00

To the aforesaid sums received as aforesaid by way of advancement we have added the sum of $462:12½ cents, the distributable surplus due to estate from Edmond Slone the Administrator as appears from the Admin Settlement.  And it makes the sum to be divided or distributed as aforesaid among the heirs and legal representatives of George Turnham Deceased amount to $1,171, which sum being divided into seven equal parts gives to each heir the sum of $167:28 cents as the amount of each and every of their distributable part of the personal estate of the said George Turnham Deceased

 

John S Gray having received an excess of $134:22 cts over and above his distributable share of said Estate must pay to Gideon Duval Guardian for Sally Turnham that amount and executes his note to said Gideon Duval Guardian of aforesaid accordingly.

 

Gideon Duvol having received an excess of $55.22 cts must be accountable out of that sum to Sally Turnham his ward so as to make her share amount to the sum of $167:28 cts and the balance pay over to the other heirs.

 

Henry P Spalding having received the sum of $143:87½ cents is entitled to receive the further sum of $23:40½ cts which makes the full amount of his distributable part of said estate ….. Thimas Turnham having received the sum of $40 is entitled to receive the further sum of $127:28 cts which make the full amount of his distributable part of said Estate.  All of which is respectfully submitted to the Court.
